Remember this guy? The Grossest Date Wreck ever?
If you saw the post when it first went up — first of all, tell your retinas that I send my regards. But you probably saw it all unfold.
The short version of the story is that he wanted his post removed. I checked into it and, really… Legally… I don’t have to do that. I ended up compromising with him and cropped his face out of the pictures (which was tragic because he looked EXACTLY like Buffalo Bill from Silence of the Lambs, for real) and removed his location and user name.
He also looked up my DNS information. I neglected to make it private when I bought the domain. Whew — big mistake (No worries, folks. It’s an issue that has been corrected). He got my phone number.
So, don’t hate on me for the video quality.I’m new at this. It’ll take me some time to make this an art form.

You have 48 hours to take down that post.
I will try to follow through with any action I can to take down that site.

I would appreciate it if you would remove him from your site. I would also like you to remove your entire web site which forced me to look at that gross mother. If you have the resources, I would also appreciate you using one of those “Men In Black” flashy things on me so I forget about the Crisco covered loser from hell. I would like to point out that I, and mostly everyone else (probably) forgot all about this… this… er, well let’s just say gentleman, until he decided to stir the pot up again. I laughed at him, but bore him no real ill will. But now, in honor of the SUPER FUCKING creepiness of him finding your telephone number and calling you 9 times, I’d love to see this story be spread far and wide over the intrawebs just to warn any potential woman from ever dating him. Ever. I hope it happens!

I don’t know where you checked about having/ not having to take down the information, but you may have some bad information. http://mason.gmu.edu/~montecin/copyright-internet.html
It states pretty clearly here that anything posted on one website cannot be copied and pasted to another website without permission from the author. There is an exception for satire, but you are only allowed to republish sections of merit for your work- not the entire thing.

Well, from the legal advice I got, once you upload images and enter text into another website such as a dating site, the information is not longer “yours” and the dating site is the proper owner. If I was asked by the hosting dating site to remove the posts, I certainly would. But not until I got a cease and desist.

since his profile is not under copyright, jami, you are correct that it would have to be POF or OKCupid who would be able to challenge your use of their images/format. the “personal” information he voluntarily places in the internet on more than 11 different sites is obviously not subject to copyright protections.
In terms of a cause of action for misappropriation, he’s got nothing. he was the one parading some nasty ass pics on the web. if anything i think we should form a class action lawsuit against him for infliction of emotional distress.

It’s scary that he was able to find your phone number. Really scary. I know you want to keep the post up on principle, but this guy is obviously mentally disturbed, so I would take it down. If he knows your phone number, he knows where you live.
